Week 6 Discussion 1

Define “corpus delicti,” and give an example of how a defendant may be prosecuted for murder when the victim’s body has not been found. Describe three ways a murder can be established without a body.

“Corpus delecti “ defines and supports that a crime has been committed and is the evidential fact that has been established to conclude as basis and support for case to conclude.

An example of how a defendant may be prosecuted for murder is based on the fact that evidential remains of a foul deed that consists of DNA evidence is found around in a defendant’s home, car or any structure that is owned by such.

Example below
(excerpt from http://legal-dictionary.thefreedictionary.com/Corpus+delicti)

CORPUS DELICTI. The body of the offence; the essence of the crime

It is a general rule not to convict unless the corpus delicti can be established, that is, until the dead body has been found. Best on Pres. Sec. 201; 1 Stark. Ev. 575, See 6 C. & P. 176; 2 Hale, P. C. 290. Instances have occurred of a person being convicted of having killed another, who, after the supposed criminal has been put to death for the supposed offence, has made his appearance alive. The wisdom of the rule is apparent; but it has been questioned whether, in extreme cases, it may not be competent to prove the basis of the corpus delicti by presumptive evidence. 3 Benth. Jud. Ev. 234; Wills on Circum. Ev. 105; Best on Pres. Sec. 204. See Death.

Three ways a murder can be established with a body are:

1. Based on evidence that may be circumstantial and relying heavily on forensics as support.

(Per Wikipedia 350 cases of murder have been held in the United States)
Reference - http://en.wikipedia.org/wiki/Murder_conviction_without_a_body

Case – People v. Scott 176 Cal. App. 2d 458 (1960)

2. Case – Reiser v. Dubois et al

Case Observations – missing Nina Reiser (formerly Nina Sharanova).

Passenger seat removed – remnant of blood in car and blood splatter in house.

Convicted 4-28-08 and body found 7-7-08 led there by Reiser later.

He was convicted without body based on circumstantial evidence and investigation.

3. Case – State vs. Richard Grissom (Case 6113)

In prison for allegedly killing three females and being sentenced for murder – Life from November 20, 1990. He was convicted with little evidence to substantiate claim of murder of “4+”.

Knife ??? – was it found? Any DNR of women found on Grissom? Elderly woman – how is she tied into this (was she the one called police and said)

excerpt from http://murderpedia.org/male.G/g/grissom-richard.htm

Hinkle led the investigation of the Brown and Rusch murders as well as multiple searches of the field near Clinton Lake. The field was searched because a resident in the area recorded a license tag on a vehicle seen there at the time of the murders. It turned out to be a stolen tag later found to be in Grissom's possession.

Grassy field investigated – nothing found – who was the caller and why did they not call the police if an act of violence was committed and they could see it?

Discuss the differences between murder and manslaughter, as well as voluntary and involuntary manslaughter. Provide an example of each.
Murder – is the killing of an individual without lawful justification committed in the first degree which are acts of physical violence that would result in death with true intention to kill, do bodily injury to another (individual) with knowledge that these acts will result in death and assurance that great bodily harm will increase probability of death and knowing that a felonious act of behavior apply.

EXAMPLE

Jane waited until Bill went to sleep and struck him repeatedly with a hardened wooden oak of wood in head until she heard a crack in his head.

Mallock watched Bob place his wallet full of cash he had just won that night at the casino under his pillow…creeped in and shot Bob in his chest killing him instantly and stole the wallet and money.

Manslaughter – is classified as criminal homicide that is less than murder. This type of murder may have been provoked by the victim by either his/her action or unlawful conduct that serves as a catalyst of his/her killing. The killings are not bad enough or do not show deliberate intent to classify as murder.

EXAMPLES

Bill attacked and beat Jane viciously and in defense Jane stabbed him with a knife repeatedly.

Jane beat the hell out of Bill and he in defense clubbed her with a savage blow to her head with a candle stick.

Voluntary Manslaughter – is the killing of another person by an offender who had no intent to kill and acted during “the heat of passion” and under circumstances that would cause a reasonable person to become emotionally or mentally disturbed. Allowance of provocation serves as basis for voluntary manslaughter and the act of lack of temporary ability to act with reason.

Reference: http://en.wikipedia.org/wiki/Voluntary_manslaughter

EXAMPLES

Bob came home and found an intruder raping his wife and with no thought he flew into an uncontrolled rage of anger and the beat the rapist to death.

Melody saw a man kissing and fondling her two year old and lost her reasoning ability and crushed his skull with a hammer.

Involuntary Manslaughter – is often charged when extreme negligence or wanton or reckless conduct by the defendant brings about an unintended or accidental death.

Reference: Criminal Law, Taylor/Fritsch, 11th Edition, P. 271

EXAMPLES

Jane was texting furiously while driving and struck an elderly lady attempting to
cross a street.

Johnny was picking and combing his hair and lost control of the steering wheel and crushed a construction worker between a wall and a slab of concrete.

Week 5 Discussion 2

Compare and contrast threats of violence and bullying to determine what differentiates one as a crime from the other as a behavior.

Excerpt from Criminal Law, Gardner/Anderson, 11th edition/2012
Page 230 Page 232

Threats of Violence

1. A threat becomes a crime if it is explicit and likely to result in imminent lawless action.

2. Consequences and actions against threats can be charged as various crimes, such as disorderly conduct, inciting violence, or even racketeering. Accompanied by physical violence (model penal code, section 211.1 (1) (c) makes threats of violence an assault.

3. Threats against public officials are a violation of federal law (18 U.S.C. § 471).

4. Threats by school children against teachers or other students. To be the basis of a criminal conviction (as opposed to school discipline), the threat must be a “true threat”.

5. Terrorist threats are taken seriously (model penal code, section 211.3) are a third-degree felony to make threats designed to cause evacuation of public buildings or public conveyance.

Violations of restraining orders can subject the violator to contempt charges or other criminal liability.

Cobble v. State, 2004 WL 168877
(GA.App.2004)
(Terroristic Threat Statute)

6. Threats by mail constitute a violation of federal law.
7. Using e-mail constitutes a threat of violence and is a federal crime.
8. Unlawful use of a telephone can constitute a federal crime.
9. Unlawful harassment by electronic communication that communicates threats to a person is a criminal offense.

Bullying

1. Bullying consists of repeated harmful acts which involve physical, verbal, or psychological attacks of intimidation.

2. Directed against victims who cannot properly defend themselves because of size or strength, or because they are outnumbered or less psychologically resilient.

3. Bullying was once viewed as harmless adolescent behavior…it is now known that bullying can have a “long-term” effect on both the bully and victim, and can lead to other forms of violence.

Case – Tinker v. Des Moines
School District (control conduct on
school property)

Threats of violence is usually an aggressive overture of physical harm toward another person which could lead to great physical harm or death. Whereas bullying can consist of some physical contact with the possibility of physical harm or maybe death but mostly it is a psychological threat to affect a person mentally with the attempt to destroy another person. It may result in possible mental dehabilitating factors that would hamper them and restrict their ability to function in society whether personally or at the workplace, familial, or any possible interaction with people.

Both are behavioral patterns with aggressive underlayments and both are criminal endeavors with varying degrees of criminality that are enforceable by law if proven.

Discuss the basis for the Supreme Court’s decision that the Second Amendment is binding on the states, and how it has influenced laws concerning gun ownership and gun control.

The basis for the Supreme Court decision under the Second Amendment reflects that the use to bear arms has always been a privilege under the U.S. Constitution and is allowable for private citizens to possess such arms as long as they are registered properly and abide by the guidelines for possession. Based on the adjustments to the Second Amendment in 2008 and 2010 this further protects the rights of people to keep and bear arms for self-defense, etc.

The State and local government are extended the same power as the federal government and must abide by the same regulations and guidelines that pertain to gun possession by citizens when addressing any issues that pertain to their ownership.

Give your opinion as to why this is a passionate topic with citizens.

I believe that this is a passionate topic with citizens because some fear that the privilege will be withdrawn and they will become a victim of a predator and not having a weapon to try to even the odds causes distress to a lot of people.

Week 5 Discussion 1

In 1972, the Supreme Court struck down all death penalty laws in the case of Furman v. Georgia. Explain the Supreme Court’s decision and highlight three recent Supreme Court decisions about the death penalty since 1972.

The Supreme Court’s decision regarding Furman vs. Georgia allowed the examination of evidence and nature of crime committed … all death penalty laws were struck down as “arbitrary and capricious”. In order to use the death penalty adherence to the following requirements would have to be made:

Excerpt from Criminal Law, Gardner/Anderson, 11th edition/2012 – Page 201

1. The issue of whether the death penalty will be used in the state must be submitted to the people of the state in a referendum.

2. If a substantial majority of the voters approve the use of the death penalty, the state legislature must enact laws permitting the use of the death penalty.

3. The new state statute must determine which crime (or crimes) could be punished by the death penalty, whether it will be the trial judge or jury who will make the decision to impose it, in what method it will be inflicted, and the appellate process used to review the sentence.

4. The new statute must require juries or judges considering the death penalty to make findings of statutory aggravating circumstances to justify the imposition of the death penalty and also make findings of the mitigating circumstances that would weigh against the imposition of the death penalty.

All of these requirements would have to be incorporated as new procedural policy and allow adherence to support the sentencing and administering of the death penalty to be executed and fulfilled. Therefore because no procedural process was in motion to determine which defendant shall live and who should die nor was there a consideration of which crime was a sure guarantee for the death penalty that was clearly delineated and this caused a violat5ion of the 8th and 14th amendments.

Three or more recent Supreme Court decisions that related to the death penalty since 1972 are:

1984 Pulley v. Harris 1986 Ford v. Wainright
1976 Jurek v. Texas 2006 Panetti v. Dretke
2005 Roper v. Simmons 2002 Atkins v. Virginia
2008 Baze v. Rees 2002 Ring v. Arizona

Analyze the benefit and impact of the “three strikes” laws or statutes dealing with career criminals. Discuss the pros and cons of such laws, and whether you think they have any impact on repeat offenders.

The benefits and impact of the “three strikes” laws or statutes that deal with criminals include the imposing of a 25 to life sentence on the completion of a felony that constitutes a third violation of legalistic laws and compels the justice system to sentence violators under the “three strikes” law. Because of the enforcing of these laws parole is not available until the minimum time is served.

PROS

Deterrent to criminals to commit crimes
Repeat felons removed off street (hardcore criminals)
Drop in Crime Rates
Longer sentences

CONS

Non-life threatening crimes affect and count toward the three strike law
Costly to budget
Burden to court system
No provisions to deal with workload
Overcrowding
Releasing prisoners earlier than stipulated

Week 4 Discussion

According to statement of allowances – prosecutors can try defendants older than 14
in adult court, without a hearing, a statement of reasons or an investigation into their background depending on crime committed.

Conservative Approach – Respectfully submit that offender be charged with murder in the first degree with a minimum of 20 years to be served. Preliminary Hearing held and subsequent hearing to either contest charges or support to conclude to summary of requested plea of murder.

Week 3 Discussion 1

Hello.

Certain acts that are in preliminary, anticipatory, or inchoate crimes are considered illegal based on the fact that preparations have been made to commit an act of criminality against a person, business, structure or object. Determining if a preliminary crime has been committed is whether sufficient planning has been done or attempted. The next step is solicitating or incitement to commit the crime.

The justification for the requirement by some conspiracy statutes for evidence of an overt act by one of the co-conspirators is to support the proof of criminal activity. An overt act or proof of an act is not necessary because the underlying crime is a felony of the first or second degree. Case to support: United v. Shabani (115 S. Ct. 382).

FURTHER:

According to the Federal Conspiracy Law <18 U.S.C. { 371> makes it
plan that proof is needed of an overt act done in furtherance of the
criminal conspiracy that is charged.

Thank you.

Everyone- From Teacher – Zara Sette

Think about how to research for a case such as this if you were the paralegal everyone?

What would your research include?

The essentials to the analysis of a legal problem: Establishing the key elements IRAC; identify the legal issue/s; identify the Rule of law that governs the issues; Analysis and application of the Rule of Law and the facts to the case and a conclusion that summarizes the previous steps.

Look for primary authority first and secondary authority when primary does not exist.

Be certain to consider counter arguments to the analysis in order to be prepared for opposing counsel.

Stay focused, maintain intellectual honesty and know when to stop researching.

Hello Ms. Sette.

I would probably began my research with the following:
1. Details of arrest (scenario)
2. Comparison of cases similar to support winning
3. Question to ask - in anticipation
4. Cross-examination questions
5. Alternate method to win case
6. Every rule ever written that may apply to case

This would be a starting point and if need for continuance I would continue.

Thank you.

WEEK 1 - DISCUSSION 1 & 2

Three Branches of Government in Criminal Law

Discuss the authority and responsibilities of the three branches of government in regard to criminal law, and how they differ.

Reference: Criminal Law: Purposes, Scope and Success, Chapter 1, Page 4
Name Duties

Legislative Branch
Laws (including criminal laws) are enacted by the legislative branch.

Executive Branch
Agencies within the executive branch of government to administer and enforce laws.

Judicial Branch
This branch deals with people who are charged with crimes and have a right to be tried before a judge or jury in a court in the judicial branch of government.

Compare and contrast public law and private law, and give two examples which illustrate the difference between criminal law and tort law

DIFFERENCES BETWEEN THE BRANCHES OF GOVERNMENT

Legislative Branch
Deals with laws – Proposals, Passing and Vetoing.
In this branch state governors and U.S. presidents provide leadership on many proposed laws by either issuing support or opposing them.

Executive Branch
Deals with most law enforcement agencies found within the executive branch of government and are charged with the enforcement of criminal laws in addition to performance of other duties.

Judicial Branch
Deals with fact finders (Jury or Judge) to determine the issues in cases presented to them, including the issue of guilt or innocent.

Each branch is separate but works conjunctly as a whole and complements each other.

Public Law

These are the laws or statutes that apply to all people with a state or nation. Also, deals with relationships between both natural and artificial persons (i.e., organizations) and the state, including regulatory statutes, penal law and other law that effects the public order.

Reference: Criminal Law: Purposes, Scope and Success, Chapter 1, Page 4

Reference excerpt from:
http://en.wikipedia.org/wiki/private_law

Private Law
These are the laws or part of a civil law legal system which is part of the jus commune that involves relationships between individuals, such as the law of contracts or torts (as it is called in the common law) and the law of obligations (as it is called in civil legal systems).

Reference excerpt from:

Criminal Law
These are the laws that deal with acts of criminality. Also, it is defined as the body of rules that define conduct that is not allowed because it is held to threaten, hurt or endanger the safety and welfare of people and that sets out the punishment to be imposed on people who d not obey these laws.

http://en.wikipedia.org/wiki/Criminal_law

Tort Law
These are laws that are used for a noncontractual civil wrong. (Victims of a crime may bring civil actions in civil courts to seek compensation from the defender.
Reference: Criminal Law: Purposes, Scope and Success, Chapter 1, Page 5

Compare and contrast reasons why a person might commit a crime, as opposed to reasons a person would choose not to commit a crime.

Reasons to Commit A Crime
1. Easy gain for money, drugs, power or other objectives
2. Little or lack of moral or ethical restraints
3. Peer Pressure
4. Belief that a person will not be labeled “birds of a feather flock together.”
5. Desire or drive to achieve illegal objective (drugs, addition).
6. Opportunity – combined with capacity and skill

Reference: Criminal Law: Purposes, Scope and Success, Chapter 1, Page 8

Reason to Choose Not to Commit A Crime

1. Consequences of Actions
2. Moral Principles
3. Ethical Concern
4. Influence of peers, friends, associates, religion, community
5. Embarrassment, social structure influence
6. Lack of motive or drive to commit a criminal act or illegal act
7. Lack of opportunity, capacity or skill to commit crime
8. Fear of economic sanction, such as loss of job or promotion, lawsuit and
damages, or loss of license (drivers or liquor license, credential for lawyer,
doctor, nurse and so on).

Give three examples of how society controls undesired behaviors, by means other than laws, and identify what are the strengths and weaknesses for each example. Reference: http://en.wikipedia.org/wiki/Social_control#Applications_of_social_control_theory

Informal Social Control

Strengths

Tedious/need for accuracy
Enforcement
Lapse of too much time

Victim/Caretaker Lens #2

1. My preference for the Victim/Caretaker Lens falls in the score range of 14. It is one of my highest lens.

2. This lens can be a great communicative tool because.

A. It can help ensure that the victim’s right are represented fairly and be an incentive to help the victim obtain the fairness that is due them. Further because the victim feels traumatized by situations beyond their control this allows discussion of unethical practices being done and hopefully these issues can be discussed, circumvented, prevented and stopped in future practices.

B. The Caretaker is also a great supporter in the communication factor because it allows them to fight for the victim’s rights. Also, being the caretaker mean finding ways to help the victim with whatever problem by communicating on behalf of the victim with different agencies. Because of the victim’s plight the Caretaker is exposed to many facets of injustices and able to help solve and resolve by representing them verbally and physically.

Scenario – Kimberly – Professor
Michael – Student
3 Unexcused absences within two months
Results in grade dropped two grades

In my opinion the Professor is not justified in dropping the grade because there could have been circumstances that was not preventable that caused the absences. I see Michael as a victim and the manner in which the students are treated is deplorable and losing some points is fairer than being cut two grades. The reason Michael is there is to get an education and not be a member of the victimized group.

As a “victim” Michael should appeal the situation immediately to the teacher’s supervisor and Board Panel because of this unfair citation in his syllabus or class attendance policy and try to get points removed and not have his letter grade dropped. If there are circumstances that Michael does not wish to reveal he should have that option.

Values of a social worker are at its extreme a demanding and caring endeavor. As a profession the area
of social work correlates to my own interest and care for people and helps me monitor my input as a
caring citizen. This field is progressively changing and evolving to accommodate the varying interaction
of diverse cultures in today’s society. Further, my values and social worker values are similar and that is
to find a rapport with the at-risk population and intermingle my experience as a person who has
progressively sought ways to help those in need and find ways to assist and focus them in the right
direction.

Assisting troubled and victimized people is the highlight of each social worker’s life and that includes
being empathetic and proceed on a non-ending mission to right some of the wrongs in a person’s life.
My goal and others is to train and be able to put myself in other’s shoes and work and strive toward
helping clients.

As a fellow human being it is my responsibility and a value of mine and social workers to help keep the
dignity, meaningfulness, self-respect, personal fulfillment that every person is entitled to. Becoming the
champion of the hurt, needy, victimized, vulnerable and oppressed is a value and goal of mine and of
social workers and also be the voice to help them be heard and protected.

Because there are so many oppressed, at-risk and disempowered populations in distress the value of
them as a people is of utmost importance and it is necessary to not be prejudicial, discriminatory and
not be selfish but selfness during the quest or venture to right a wrong and continue on a mission to
enhance human well-being and help meet the basic, necessary human needs of all people.

My goal is to continue on this path to study, observe and try to determine what might help this human
race realize the need of diverse cultures to co-exist in cooperative efforts actively and fulfill the needs of
people in need and in trouble.

Underground Railroad

I am interested in this non-profit organization serving all the residents of the County of Saginaw because it helps all victims of domestic violence, sexual assault and stalking and I wanted to find out more information about it due to curiosity. It has been in operation since 1977 and is the only provider of emergency shelter, services, leadership and programs to end domestic and sexual violence in the community.
Further, domestic violence does not discriminate it can happen to anybody in any race, religion and economic group. While participating and trying to obtain my volunteer hours with this organization I was assigned to work at the Thrift Store (Under the Rainbow) because I did not want to go into the inner confines of the Underground Railroad until I received more training.

I was treated fairly and worked there 3 hours sorting and organizing blankets, quilts and sheets but due to back pain and not having enough monies to continue traveling there and after my being excused from this obligation I ceased working at the Thrift Store. But I was able to find out a lot information about the services that they provide, e.g., The mission of the Underground Railroad and that is to provide services for survivors of domestic violence, stalking and sexual assault, their leadership role for eliminating violence against women within our community, their commitment to maintain adequate facilities, staffing, equipment and resources to support programs to continue to assist, their further commitment to diversify and expand funding sources to enable the corporation to adapt to the changing political and economic environments and goal to enhance and expand community understanding and support for their mission.

What strikes me as most significant is the knowledge that domestic violence and sexual assault are damaging to the victimized and society as a whole and that this violence is rooted in our social structure and produces significant inequities in roles, relationship, resources, and power between women, men, and children. Further, it has to be acknowledged that domestic violence and sexual assault is criminal conduct which will not be tolerated and that prevention through education, advocacy and appropriate intervention is the ultimate goal. Furthermore, all victims should be provided with sanctuary (safety) and must be treated with dignity and respect and help should be provided to empower the victims and

seek social change which addresses the existing imbalance of power within violent relationships. Counseling should be recommended to assist in making informed choices for themselves and their children to provide safety, information about domestic violence, available options, and community resources and to this end the Underground Railroad will be there to provide leadership in this community on issues affecting survivors and be accountable to survivors.

The history of the Underground Railroad is unique because an attorney from Legal Services of Eastern Michigan, Barbara Klimaszewski, identified a need for emergency shelter for battered women and their children in 1976 because there were no specific statutes in the State of Michigan pertaining to spouse abuse, which left the victims of domestic violence without protection and little recourse for any legal intervention. The solution to this quandary became readily apparent that the only means for protection for these women and their children was to flee their residence and seek temporary shelter. Fortunately, for this county a group of women from the Saginaw area formed a group called the Feminists United for Social Equality and proceeded to establish the Underground Railroad, a private non-profit corporation “to provide and operate a shelter for battered women and their children.”

Elected to help this shelter (Underground Railroad) operate is the board of directors which consists of four officers and five assistants to help in the everyday operations. Their duties is to expand the knowledge of the Underground Railroad and ensure new policy is elected and enforced and for the year of 2010 a new program was enacted “Advocates for Change Society” which was launched in May to build a self-sustaining giving program of loyal, long-term supporters who are committed to the Underground Railroad Mission.

Some of the services they provide is hotline for crisis and support 24 hours a day, 7 days a week, 365 days a year providing callers with intervention, support, understanding and information and referrals as necessary, emergency shelter is offered to females with children, adult male victims and transgender victims who are in imminent danger, advocacy-counseling and support groups, court support and legal assistance, housing assistance for survivors, youth advocacy and childcare, secondary survivor services, safe place supervised visitation and safe exchange, prevention education programs, community awareness presentations, and collaborative programs.

Transcendent Len

My preference for the Transcendent Len is on a scale of “12” and this is one of my highest lens. I really believe that God exists in all of us but some people are very hedonist and only believe in themselves.

Ari’s characteristics that I can agree with are that he is very optimistic and uplifting morally. His soul is reflected as being very human in troubled times when others are so shallow and lack self-control. His air of being a very socially conscious individual is reflective of whom he is and his non-stopping attempts to help others is commendable but a person can only help you if you wish to be helped and accept your hand to help guide you on your path of a new future.

This lens can help communicate with others at work because it reflects openness and pragmatic characteristics and the ability to be very empathetic. Further people with issues on the job need someone to help them reach their goals and hopefully make and reach new goals.

My response/reaction to the retreat would be to try to stay neutral and non-judgmental and anything unusual and unique would prick my curiosity and I would be willing to participate as long as I had some information about the situation. If it is just praying and chanting then I would have no problem but actual total conversion would have to be something I would have to think about. Further according to this profile we must respect, honor, different races, personality traits and belief of God is beautiful and enlightening. Further our physical form is a vessel our soul dwells in and is our tool to perform the necessary chores of life and are blessed life givers.

I agree with the stance of the position that the company’s has taken and that in order to deal effectively in business we must be flexible and tolerant of unusual cultural behaviors when in other countries or within this country to merge and make the deal.

Book Report on Southern Horrors - AMERICAN HISTORY

SOUTHERN HORRORS
BY IDA B. WELLS-BARNETT

This book is a compilation of cruel injustices done in the Southern states located in the United States.
Authorized and written by Ida B. Wells-Barnett who was the owner and journalist who reported the acts of unjustifiable acts of savagery aimed at Colored or Negro people in various states located in the South. This report reflects what is known that the mingling of the two races is not desired or wanted in the South in the past or the present. Further because of this attraction between the two was the eventual act of being found out sinning and the result of offspring being born reflected activity between the two races when it resulted in a mulatto offspring. Consequently, the Negro man was punished, maimed, hung and killed in various violent acts of hate and prejudice.

The Negro race is thought of as being inferior and that is why they are dehumanized and cruelly set upon by a mob that acts en masse and shows or feels no guilt for their actions of savagery and is a strong arm tactic that curtailed the acts of rape by Negro men who did not get a trial. As noted and studied people like to act in mobs to shield themselves from being charged individually for crimes committed. Ever has it been the misfortune of the Negro race to be hated, reviled, exploited, perjured against and just hated for their very differences. Harsh is the justice relayed to Negro men accused of raping a white woman because of the damage done to her very reputation or the reputation of white women. Also, if one incident is allowed then others would follow. Once a Negro man has overstepped the boundaries of correct and appropriate behavior he is summarily dealt with the harshest, cruelest punishment with swift immediacy. Sometimes he is given a trial or is left in the hands of a vigilante crowd of white men. The very thought of a Negro man being intimate with a white woman is hated, resented and will not be allowed after she has been exposed to public scrutiny and because she is held in contempt some white women cry “rape” to not be despised by her own race and spat upon.

Because of the increase of copulating between the two races Southerners took other measures to constrict and prevent this merging of the two race by incarcerating some for miscegenation whether they were demi-monde or appeared white (light complexion Negro). Any offspring from a Negro man was viewed as “rape” and the white woman who had the child was disgraced and the only way to restore her honor was to have the “alleged rapist” killed.

Further, white male aggression and acts of savagery aimed against Negro children and adult Negro females were not punished. Many crimes were committed against those who were in the wrong place at the right time and because of justice not being brought against the white men who committed these acts of rape these actions brought forth resentment by the Negro man who cried foul play by white men and started boycotting businesses by the very unfairness of a white man not being tried and punished properly. The appalled, offended, shocked refused to patronize services, businesses and companies that treated them less than human and judged them guilty of any crime committed.

PLANT - GlobalWatt
New Proposed Solar Plant for Saginaw

Thanks to Katherine Latimore’s care for her surroundings and the blight that is continuing afflicting cities small and large. The brave and gusty Latimore, 65, (one of our treasured citizens of Saginaw, Michigan) gathered together dozens of neighbors and rallied against the construction of a federal prisoner halfway home now located at Leon Scott and Norman. Which to my opinion was and is a waste of time and money when there was already a suitable building on State Street which was torn down at the expense of the City of Saginaw (please verify this). Furthermore, that building was closer to the City of Saginaw Police Department where any disturbances could be quickly staunched.

Although, I stated that it was a waste of time and money the half-way house that was built to replace the old building is a very nicely built and kept facility and by glancing at it you can tell that someone is being kept there due to …should we say allegedly wrongdoing (that is the question that everyone is asking) when they are being let out early and continue to break the law and get into the same mischief over and over.

Now for a positive note we (City of Saginaw citizens and surrounding counties) are elated that a new plant (Global Watt of San Jose, California startup company) (valued at $177 million) is coming to the City of Saginaw. This plant is by far the most positive thing that has happened to this city in a long time and will hire approximately 500 workers within five years. Also, due to the anticipation of having a new plant in this area this good news, as well as having, a community police officer patrol the neighborhood, continuance to demolish the Northeast Side’s eyesores and the improvement of roads is just like having icing on a cake and being able to eat it too.

The City of Saginaw’s resident are happy that the Citizens of Saginaw (residents of Saginaw) are coming forth and letting everyone know what is going on instead of listening to gossip and speculation. According to the Saginaw News the proposed location of this plant will be located at 1200 Leon Scott which is blighted and features a criminal element that remains but has slowed in recent years.

The reason why the criminal element has slowed and is steadily being constantly removed is due to the City of Saginaw Drug Force Elimination Team. This team is constantly and continually working to wipe out this criminal element and that is why this section is not worser than it could be. Maybe some representatives of the City of Saginaw and from the GlobalWatt Plant should go to bigger cities like Flint, Detroit, New York and others and you will

see a lot of deteriorated neighborhoods due to lack of jobs and the breadwinner’s inability to maintain their homes and families due to lack of employment. This is why there is so much crime because no one is going to let their families starve. The lack of jobs and the continually closing of so many companies, plants and the list goes on and on to explain why so many people are out of work is increasing the outporing of criminal activity everywhere.

So any action on your part to not put a plant where it will help end some of this criminal activity will not help the City of Saginaw financially, emotionally, or positively. But doing so will help this city get back on it feet. This will help the City of Saginaw get more contracts, generate more money to enable wise investments and obtain more capital for the City of Saginaw. This will allow certain members of the City of Saginaw Council Members to learn to invest and diversify a certain amount of money of the City of Saginaw to start earning interest and monies on behalf of the City of Saginaw Residents.

Thank you for reading and listening to me.

Seclusionist Lens

My preference for the Seclusionist Lens falls in the category score range of “11”.

Because I am rather laid back when it comes to this section this is appropriate for because I believe in allowing people to make free choice.

Some of Frank’s characteristics that I agree with are that he is uneasy about who is moving in the neighborhood and who might cause unusual negatives waves in the community. Some people are unfortunately criminal and have a determined mindset to cause mayhem and cause irrevocable harm. Further the ability to community with some people is impossible and dealing with them sometimes causes a lot of stress. Furthermore, some people feel more comfortable dealing with their race.

This lens can be used to communicate with others because they are able to branch our professionally and still retain a reclusive nature. Further they are able to express and communicate that they don’t mind some involvement in their race but limit the relaying of useless behavior patterns.

The Seclusionist Lens is very close to the Cultural Lens because both have a lot of similarities. They both believe in retaining individuality of races and the lack of need to fully assimilate in another race. Learning self and who you are is important to both and being yourself is tantamount to Gold. Furthermore, people of different races, ethnicities and economic/social status can exhibit similar attitudes regarding certain situations, interactions problems and complete empathy scenarios.

RUNNING WITH SCISSORS - Brief Analysis

By Felicia McCaw

This story is a compelling autobiography of Augusten Burroughs and has very unique qualities of true life events and mini events that has affected the writer’s life.

A brief analysis based on Cynthia Crosson-Tower Understanding Child Abuse and Neglect.

The family identified in the book is a nuclear family. The family has no true steady home but is relocated several times throughout the book.
The mother’s role was actively dysfunctional along with the son’s role with no chance to establish normalcy.

Communication was done reflective of silences, mood swings, facial expressions and voice tones and conveying all messages.

No established rituals, family traditions but some holiday celebrations with life rituals.

As per Crosson-Tower as reference the criteria for completing basic tasks have not been met:

1. Failure to complete basic task which involve everyday living established procedures and normal habitual requirements.

2. Failure to adapt to changes brought on by developmental tasks – improper or lacking of ability to evolve and develop emotionally, develop relational values, moral values and mental acquiesce to stability.

3. Failure to deal with crises – inability to deal with miniscule to higher levels of crises. (For example, rejection at poetry reading, arguments with husband, homeless state.)

4. Failure to deal with societal pressures:

Inability to go to school, pressure and stress allowed admittance to mental hospital.

Parent – Child Relationship

Established later in book mother has a mental condition.

A. Unstable
B. Mental condition does not allow the ability to fulfill childhood needs of son (Augusten).

Forensic Psychology
CAD Crime Scene Reinvent
(New Software Package)

By Felicia McCaw

Ms. Felicia McCaw

PROPOSAL

I. Forensics Psychologist Analysis of Crime Scenes Evidence Modification & Streamline Proposal (CAD Crime Scene Reinvent) Software Package

II. The purpose of this proposal is to use a software package to reinvent the scene in direct or simulated physicality format which takes the image of the physical scene and breaks it down into modules to give the court system a slow methodical re-enaction of the scene carried through step by step. Minute details will be examined and detailed reports are being compiled to relay to examiner of the proposal the evidence of its feasibility and usefulness. Correlated reports are being checked to further test the software validity and reflect the ration of eliminating errors and the odds of checking, catching and correcting glitches. This new software will reflect the actual crime pieced together to be examined and increase the odds of plausibility to eliminate the ration and odds of errors.

III. Crime Scene Examination Process

A. The creation of several scenarios are being done with the analysis of situational crime and a compiling of evidence for each scene and the initialization will begin the analysis of the recreated scenario with the old CAD system and the new proposed CAD Crime Scene Reinvent Software Package.
Situation 1 – Currently the crime scene is being reenacted by CAD which allows the input of data from the crime but gives a poor portrayal of the scene. Because of this the analysis and re-enaction is not able to be used as evidence and viewed suspiciously as trumped up information. The problem with this software is that it is unable to give a clear schismatic of the scene and leaves out important timing and slows down the visual effects therefore creating the illusion of facts left out and probability factor unanswered and unaccounted for.

B. CAD Crime Scene Reinvent is a prototype presently given to the U.S. Security and Crime Prevention Team that is being utilized by my company. It is one of the most unique futuristic tools that will allow the cut down of investigation

periods and compiled in sequential number format accessible by the Police Department and Investigative Teams only. Testing has revealed that if far exceeds the first version of CAD by its meticulous details and views of several possible scenarios to be examined and the old system will be put into obsolescence and the new CAD Crime Scene Reinvent will be modified and its flexibility increased to incorporate into new written mini programs which will consist of a new computer language to accommodate future changes. Further it will allow a trigger point to point out any inaccuracies or non-logical data that is entered incorrectly. Because of the dismissal of crime forensics evidence and portrayals this new software was devised by my company to accurately reenact crime scenes.

C. Visual effects are increased, to magnify and reflect the new system’s clarity and better visual capabilities and images are modified to slow down the visual effects more and increase clarity of images retain probabilities that can be altered or maintained.

D. All modifications and updates to CAD Crime Scene Reinvent software will be relayed to the U.S. Security and Crime Prevention Team to test effectiveness and sound proof errors or options that they would like to have incorporated in the software package.

E. Funding for the software developers and presentation of this project and initiation into the current police department and investigative team database additions is required. The main theory to be relayed is the conciseness of the software and its relative inexpensiveness to implement and the ability to prove without a doubt the accuracy of information compiled to support the Investigative Team Analysis of the Crime Scene and prosecution of the accused culprit.

F. Further testing of the sequential number format will be deviated and altered for easier accessibility for the Police Department and Investigative Teams only. Additional triggers will be entered and accessibility and functionality will be used for analysis.

IV. Scope

Scope of this software will be allowed to be expanded as it is utilized and a modified and adapted software package can be sold to private investigators. Steps to put software in usage will have to be introduced to the President of the United States, Head of Security and examined by Data Processors of the United States as to the feasibility of usefulness to the Police Departments and Investigative Teams across the United States. The limits of this project is the lack of funds to develop further and by introducing this software it can be developed, expanded, utilized and discreet questionnaires and selective clients are being contacted to check if feasible to continue.

Summary of Proposal

The purpose of this proposal is to use a software package to reinvent the scene in direct or simulated physicality format which takes the image of the physical scene and breaks it down into modules to give the court system a slow methodical re-enaction of the scene carried through step by step. This new software will reflect the actual crime pieced together to be examined and increase the odds of plausibility to eliminate the ration and odds of errors.

Multiculturist Lens

Multiculturist Lens

1. My preference for the Multiculturalist Lens is one of my highest choices and has a score of 15.

2. The characteristics that Lorraine possesses that I agree with are that she is able to see what is necessary in any company. That an infusion of all races is important in a diverse cultural society and that everyone has unique capabilities that they can contribute to the overall success of the company. Further allowing input from all cannot but help mediate any present or future problems because these potential hurdles are being approached in the forefront and should alleviate some of the issues that cause misunderstandings in the present or future. Furthermore, as a person who deals with people on a constant basis it is in her favor to treat all fairly and equally and obtain viewpoints from all and incorporate their inputs into modified plans to help the company expand and grow to assist all with diverse issues.

3. This Lens can be used to communicate and work with others because this person is sensitive to the needs of other people and has the ability to provide empathy and meet them on level ground. Also, one of the greatest things about this Lens is centering and knowing that you can help this person or individuals of diverse cultures because the most tantamount goal is to maintain peace and keep productivity at its highest level.

Paul’s response to Andrew would be pretty much the same but he has a more legitimate basis to promote Vicki and not just for the purpose of fulfilling an affirmative action requirement. Further reflected here is a person getting a promotion on bias – but with the appropriate qualifications the promotion becomes a non-biased decision. Further, Andrew would not have any legal recourse and would not win the lawsuit.

The Most Powerful Influences on My Life

The Most Powerful Influences on My Life

The most powerful influences on my views of the world was and is my parents, aunt, teachers, family and my vast reading of a multitude of books. My life was affected tremendously by learning to work and starting at an earlier time frame in my life. I began at an early age of five trying to wash dishes at my aunt’s house who I considered a second mother. I was rather a precocious child, observant and willing to watch and learn early.

My mother and father taught me the value of earning a living for myself and provided cautioning advice and discipline which prevented me from getting into trouble. I was my father’s shadow and followed him everywhere and said “I want to be just like you.” and was the son he never had…a typical tomboy who enjoyed fishing, outdoor tasks and learned how to unload, load a truck, change a tire and take items to the dump, scrap yard and helped tear out and remodel a house for him and mom. I remember that I told him that I wanted to learn how to install windows and doors but I waited too late and my father passed away. As I grew up watching my mom struggle to raise nine children and work incessantly and showing the most admirable determination to not beg and be responsible for their care…I am still rather intimidated by the amount of work it took to raise us and have tried to live up and measure up to a fragment of my parent’s worth. Even now I see her and my father as my role model and I want to make my dream come true which is also my parents’ dream for their children is to accomplish what was out of their reach.

These various tasks of labor as well as discipline helped form my character which is rather stern, rigid and with an uncompromising attitude that I am not for sale and cannot be bribed by the trappings of the world, money, prestige, fame,

etc. and is something that I negate as not the highlight of my life, but obtaining my degree is still uppermost in mind and my most precious goal. I still like to have some fun sometimes but I am rather reserved as to whom I associate with because of the lack of similarity, different upbringing, taste, age and the lack of integrity I see in a lot of people determined to destroy this person and that person.

Because of the differences in myself and others my views of the world changed when I moved into a housing structure which included a variety of races from low to medium incomes. Never being exposed to the lack of discipline I found there in a lot of the teenagers and adults shocked my world. Being a rather grouchy person who hates their possessions to be borrowed, worn by others, and stolen I found myself subjected to this rude behavior to my sheer horror and the thought of living in that structure made me act out of character and I became a person who had to evolved to what I call the lowest caliber that I could achieve and became a hostile, mean person that had to stand up for their rights in that commune. Further, the tenants and their company, strangers were invading my apartment and taking my property and coming in on me when I was sleep. I even found some suspicious ashes in my basement that made me suspect that someone was smoking crack in my apartment and this further horrified me because I was responsible for any actions that occurred in my housing structure. My viewpoint changed 360° and I became so stressed that I became ill because of the thought of someone doing weird things, e.g., cutting my hair, stealing my jewelry and God knows what else these people were doing when I slept. My views have changed to acknowledge that not all parents rear their children with responsibility or know where they are or what they are doing. Further, some just don’t care and it is rather a despairing thought that this behavior is allowed, nurtured and passed from generation to generation.

I have just about given up on society and the continual lack of attention to social norms and just feel like walking away but I still hope someone will reach out and save their child.

American History 222 Mid Term Exam

Midterm Exam for History 222

#4 Discuss the lives of African Americans from 1877 through the 1920s. Make sure you address the black codes of the South, exclusion from industry, migration and the Harlem Renaissance. Also analyze African American influence in politics, religion and culture.

African Americans of the past and present. Have we evolved?

The lives of the African American during the times of the 1800s were a bittersweet lot oppressed and yet free, seen and not, heard and not, dehumanized, discriminated against to serve a purpose because of the differences of races. During the period from the 1877 forward the government retreated from the South and allowed the Southerners control of their states to govern and write laws to govern all within the states as they decided. Further, because the African Americans outnumbered the white race in the South steps were taken to regain control and many ruthless actions were done to repress and reduce a black man, black woman or black child back to their proper place as the white race decided. The Southerners took revenge against them because of the deprivation of their lifestyle they were used to and position as a political force in the overall picture of American politics. The African Americans became the whipping post due to the South losing its control over this race and ruthlessly set about taking control back to ease their fears of being retaliated against because of the treatment they had issued out to African Americans and the fear of being massacred was a reason they acted so.

During the 1880s according to the census data compiled African American men and females had diverse occupations but were still oppressed and lived in a depressed era . The majority of African American men were unskilled laborers or service workers and this was the only avenue for them to survive. Unfortunately, prejudice and racism was so ingrained that obstacles were placed in front of African American males and females to prevent them from achieving economic success.

The Jim Crow Laws was put in motion which allowed the segregation of the people in many forms, e.g., living quarters, entertainment sections, transportation, educational rights and many others. The right to vote was made hard by being under attack physically, schooling of African American children was hampered due to lack of inadequate funding and appropriate learning material. In 1890 a law was passed requiring separate accommodations for colored (people of mixed ancestry – white and black), black and white passengers on railroads.

The Black Codes were passed throughout the United States to limit the basic human rights and civil liberties of African Americans to control the labor, movements and activities of newly freed slaves. Further, the codes caused the African American males and females to be regulated and placed in an inferior position and treated as if they would not work unless they were coerced. It also emphasized that any individual with 1/8 or more African blood as persons of color and was subjected to the special provisions of the law. Also, these codes were enacted to secure a steady supply of cheap labor which kept the African American males at a disadvantage and enforced the idea of their inferiority. Furthermore, these codes granted African American certain rights such as legalized marriage, ownership of property and limited access to courts and denied them the right to testify against whites, to serve on juries on in state militias or to vote. Also, the Black Codes required African Americans to sign yearly labor contracts and if they did not they could be arrested and hired out to white landowners.

The Black Migration started due to the demand for industrial goods and the need for laborers to work. Many African Americans migrated from the South to acquire better paying jobs for himself as well as for his family. Racial prejudice was still prevalent in the North and the African (Black) American were viewed suspiciously as strike breakers and were attacked, killed and hung.

The Harlem Renaissance movement was the epitome of who African American is and reflects the culture and that is it is a reflection of the best facets of African Americans and that is it signifies an artist dreams relaying artistically of who and what they are. This period served as a turning point for African Americans because it allowed creativity to flow and allowed the mergence of other races to reach out and embrace art, jazz, poetry and transcend it to unknown levels of enjoyment. It is history and life magnified by the African American race and shared by many and enjoyed by a lot of musically inclined, artistic and other people.

African Americans have fought and died to participate in political rallies to try to be viewed as a person of equality with feelings, dignity, honor and pride. Further, African Americans have struggled and fought to pray and have church sessions without fear of reprisals. The African American race culture has diversified and evolved to something besides being a clone of other races.
