Week 10 Discussion 2
In 2010, Arizona passed a state statute aimed at illegal immigrants. Discuss what the statute would permit the police to do, and whether immigration crimes should be handled under the jurisdiction of federal or state law.
The statute SB 1070 passed April 23, 2010 to allow the curtailing of illegal immigrants in the State of Arizona and United States. Based upon this Arizona passed a state statute to fulfill the acts of the SB 1070 statute. This would allow the police to detain and ask for immigration documents and if unable to produce would be looked as a criminal act and deported. Also, there is an allowance for people to sue local government or agencies if federal or state immigration law is not enforced. The local jurisdiction which involves the state level and federal have the right to stop, request immigration paperwork, apprehend if lacking, process and relay to deportation.

Compare and contrast “civil” and “criminal” contempt, and the punishments applied to each type.

Contempt of Court – refers to actions which are of a defiant nature of a Court’s authority and involves the casting of disrespect on a court or impedes the Court’s ability to function properly.
Civil Contempt – happens when a party (either defendant or prosecutor) fails to adhere to an order by the Court which causes injury to either the defendant or prosecutor by lack of compliance. Either can receive a fine or time in jail and be kept indefinitely until compliance is met and are denied their civil rights.
Criminal Contempt – involves the actions of a party causing a serious disruption in a court room, yelling at the judge or refusing to testify before a grand jury – not taking the 5th. Either can receive a fine or a certain amount of time in jail.
